1. Purpose, Scope and Definitions

1.1 This Acceptable Use Policy (this "Policy") sets out the rules that apply to any use of the FixAdmin software-as-a-service platform, including its web and mobile applications, the public marketplace directory, the public order-tracking pages, and the WhatsApp messaging features (collectively, the "Service").

1.2 This Policy forms part of, and is incorporated by reference into, the FixAdmin Terms of Service (together with the documents referenced therein, the "Agreement"). Capitalized terms used but not defined in this Policy have the meanings given to them in the Agreement, including "Customer" (the business subscribing to the Service), "Authorized User" (an individual authorized by the Customer to use the Service under the Customer's account, such as an administrator, technician, or salesperson), "Customer Data", "End Customer" (a customer of the Customer's repair business), "Subscription", and "Order" (a repair or service order recorded in the Service).

1.3 This Policy applies to the Customer and to every Authorized User. The Customer is responsible for compliance with this Policy by its Authorized Users and by any person who accesses the Service through the Customer's account, whether or not authorized by the Customer, except to the extent such access results from FixAdmin's failure to comply with its security obligations.

1.4 Use of the WhatsApp messaging features is additionally subject to the terms and policies of Meta Platforms applicable to the WhatsApp Business Cloud API, including the Meta Business Messaging Policy, which the Customer accepts directly with Meta as the holder of its own WhatsApp Business Account ("WABA").

1.5 The examples given in this Policy are illustrative, not exhaustive. Conduct of the same nature as the conduct described is equally prohibited.

2. General Prohibitions

The Customer and its Authorized Users must not, and must not permit or assist any third party to:

2.1 use the Service for any purpose that is unlawful, or in any manner that violates any applicable law or regulation, including data protection, consumer protection, and electronic communications laws;

2.2 use the Service to commit, facilitate, or conceal fraud or any deceptive practice, including recording fictitious Orders, sales, or payments;

2.3 upload, store, or transmit through the Service any content that infringes the intellectual property rights, privacy rights, or other rights of any third party;

2.4 upload, store, or transmit malware, viruses, or any other harmful code, or use the Service to distribute such code;

2.5 upload, store, or transmit content that is defamatory, harassing, threatening, or that incites violence or hatred, including in free-text fields, notes, or media uploads;

2.6 input personal data of any third party (including any End Customer) into the Service without a lawful basis and, where required by applicable law, the authorization of the data subject; as between the parties, the Customer is responsible for the lawfulness of all Customer Data it or its Authorized Users enter into the Service;

2.7 impersonate any person or entity, or misrepresent an affiliation with any person or entity, in account information, in communications sent through the Service, or in any marketplace listing;

2.8 reverse engineer, decompile, or disassemble the Service, or attempt to derive its source code, except to the extent such restriction is prohibited by applicable law;

2.9 resell, sublicense, rent, or operate the Service for the benefit of any business other than the Customer's own repair business, except as expressly permitted by the Agreement; or

2.10 use the Service in a way that damages, disables, or degrades it, or that interferes with any other customer's use of the Service.

3. Prohibited Data — Special Categories and Data of Minors

This Section 3 is a core rule of the Service. Please read it carefully.

3.1 The Service is designed for the operational management of repair shops. It neither requests nor requires any of the following categories of data, and it provides no fields intended for them:

    (a) health data;     (b) biometric data;     (c) government-issued identification numbers of individuals (such as national ID, cédula, RUT, DNI, or passport numbers), other than a business tax identification number that the Customer voluntarily provides for its own company profile; and     (d) financial account data of third parties (such as card numbers, bank account numbers, or banking credentials).

3.2 Prohibition. The Customer and its Authorized Users must not use free-text fields (including device and fault descriptions and notes), file, photo, or video uploads, or any other input mechanism of the Service to store or transmit any of the categories of data listed in Section 3.1, or any other special categories of personal data under applicable law. This prohibition applies regardless of whether the Customer believes it has a legal basis; the Service is not designed to process such data; any such data submitted in breach is the Customer's sole responsibility.

3.3 Data of minors. The Service is not directed to minors. The Customer must not knowingly enter personal data of a minor into the Service except identification of a device's owner provided by the minor's parent or legal guardian in the course of a repair, under the Customer's sole responsibility. The upload, storage, or transmission of any content that sexualizes, exploits, or endangers minors is absolutely prohibited, constitutes a severe violation under Section 10.3, and will be reported to the competent authorities where required by law.

3.4 Device unlock codes. Where the Customer uses the optional feature for recording an End Customer's device unlock PIN or pattern, it must do so only in the field designated for that purpose, only where the End Customer has provided the code voluntarily for the performance of the repair, and it must not copy that code into notes, free-text fields, or media uploads. The designated field is deleted automatically when the related Order is closed and is never shown on public order-tracking pages.

3.5 Remediation. If FixAdmin becomes aware of data stored in violation of this Section 3, FixAdmin may require the Customer to delete it within a stated period, and may delete the data or suspend the affected feature or account in accordance with Section 10. The Customer remains solely responsible for such data and for any consequences of having stored it.

4. Security Testing and System Integrity

4.1 The Customer and its Authorized Users must not probe, scan, or test the vulnerability of the Service, or conduct any penetration test, load test, or security assessment of the Service, without FixAdmin's prior written authorization.

4.2 The Customer and its Authorized Users must not circumvent or attempt to circumvent any security or integrity measure of the Service, including authentication, application attestation, rate limiting, tenant isolation between companies, or access controls; must not access or attempt to access any account, company, or data other than their own; and must not attempt to guess, enumerate, or systematically test public order-tracking codes.

4.3 The Customer and its Authorized Users must not take any action that imposes a disproportionate load on the Service or that is intended to disrupt its availability.

4.4 If you believe you have found a security vulnerability in the Service, report it to [email protected] and do not exploit it, disclose it publicly, or access data beyond the minimum necessary to demonstrate it.

5. API, Automation and Fair Use

5.1 The Customer and its Authorized Users must not access the Service by any automated means (including bots, scripts, crawlers, or scrapers) other than through the interfaces provided or expressly authorized by FixAdmin for that purpose.

5.2 Automated bulk extraction (scraping) of any part of the Service is prohibited, including the public marketplace directory, marketplace listings, and public order-tracking pages.

5.3 The Customer and its Authorized Users must not abuse any application programming interface, endpoint, webhook, or automation surface of the Service, whether or not publicly documented, including by exceeding or circumventing rate limits, message caps, upload size limits, or other technical limits, or by distributing activity across accounts, companies, or credentials to evade such limits.

5.4 Credentials, tokens, and session identifiers issued for the Service are for the use of the individual Authorized User to whom they are issued and must not be shared, sold, or transferred.

6. WhatsApp Messaging Rules

6.1 Customer's WABA; Customer's responsibility. WhatsApp messages are sent from the Customer's own WABA and phone number. The Customer is solely responsible for its use of WhatsApp messaging through the Service, including compliance with the Meta Business Messaging Policy and applicable local law, and for any charges payable to Meta.

6.2 Opt-in required. The Customer must not send, or configure the Service to send, WhatsApp messages to any recipient from whom the Customer has not obtained the prior opt-in that Meta requires, given in a manner that names the Customer's business. The Customer must retain evidence of each opt-in. Where the Service requires a consent declaration (for example, when enrolling a record in the automations module for collections or appointment reminders), the Customer must not make a false or unverified declaration.

6.3 No marketing disguised as utility. Utility message templates provisioned through the Service (such as "device ready" notifications, payment reminders, and appointment reminders) may be used only for their stated transactional purpose. The Customer must not insert promotional, advertising, or solicitation content into template variables or into free-text messages presented as transactional notifications.

6.4 Respect for opt-outs. The Customer must honor every request by a recipient to stop receiving messages, must not re-enroll or continue messaging recipients who have opted out or been automatically opted out by the Service, and must not attempt to circumvent any opt-out mechanism.

6.5 No spam. Bulk unsolicited messaging, repeated messaging of unresponsive recipients, and any messaging pattern designed to evade the Service's monthly or hourly message limits are prohibited.

6.6 Free-text window. Free-text messages available within the 24-hour customer-service window must relate to the End Customer's dealings with the Customer's business and must comply with Sections 2 and 3 of this Policy.

6.7 Meta enforcement. Meta may independently restrict, suspend, or terminate the Customer's WABA or message delivery for violations of Meta's policies. To the maximum extent permitted by applicable law, FixAdmin is not responsible for actions taken by Meta, and FixAdmin does not guarantee delivery of any message.

7. Marketplace Rules

7.1 Accuracy. Information published in a marketplace listing — including business name, description, phone number, address, geolocation, and photos — must be truthful, current, and must correspond to the Customer's actual business and premises. The Customer must hold all rights necessary to publish the photos and content it uploads.

7.2 No impersonation or misleading claims. Marketplace listings must not impersonate another business or person, use another business's name, branding, or imagery without authorization, or claim affiliations, authorizations, or official service-center status that the Customer does not hold.

7.3 No manipulation. The Customer must not create duplicate or misleading listings, use multiple accounts or companies to exceed the number of stores permitted by its Subscription plan, or otherwise manipulate the directory's search or presentation.

7.4 Moderation. FixAdmin may review, approve, reject, or suspend marketplace listings and will state the reason when rejecting or suspending a listing. Moderation decisions may be raised through the channel described in Section 10.6.

8. Plan Limits and Commercial Integrity

8.1 The Customer must not circumvent, or attempt to circumvent, the limits of its Subscription plan — including limits on marketplace stores, message volumes, and other features — whether by technical manipulation, by creating multiple accounts or companies for the same business, or by any other means.

8.2 The Customer must not abuse free, trial, or beta access, including by creating successive or parallel companies to obtain benefits intended to be provided once per business.

8.3 Access credentials are personal. Each Authorized User must have their own account; the sharing of a single account among several individuals is prohibited.

9. Reporting Violations

9.1 Suspected violations of this Policy, including abusive WhatsApp messaging, inaccurate or impersonating marketplace listings, or misuse of data, may be reported to [email protected]. FixAdmin reviews reports but does not undertake to monitor Customer Data or communications proactively.

10. Enforcement

10.1 Graduated measures. Where FixAdmin determines, acting reasonably, that this Policy has been violated, it may apply the following measures, normally in escalating order and proportionate to the severity, repetition, and impact of the violation:

    (a) a written warning, with a period to remedy the violation where remediation is possible;     (b) suspension or restriction of the feature involved (for example, WhatsApp messaging, the automations module, or a marketplace listing);     (c) suspension of the Customer's account or company access; and     (d) termination of the Agreement in accordance with its terms.

10.2 Notice. FixAdmin will give the Customer notice of the measure taken and the reason for it, before the measure where reasonably practicable and otherwise promptly afterwards.

10.3 Immediate action. FixAdmin may take any of the measures in Section 10.1, including suspension or termination, immediately and without prior warning where the violation is severe — including illegal content, content involving the exploitation of minors, attacks on the security or integrity of the Service, fraud, serious harm or imminent risk of serious harm to the Service, to other customers, or to third parties — or where FixAdmin is required to act by law or by a competent authority.

10.4 Removal and preservation. FixAdmin may remove or disable access to content that violates this Policy and may preserve and disclose information where required by applicable law or a binding order of a competent authority.

10.5 Effect. Enforcement measures do not relieve the Customer of its obligations under the Agreement, including payment obligations, and are without prejudice to any other right or remedy available to FixAdmin. To the maximum extent permitted by applicable law, FixAdmin is not liable for enforcement measures taken in good faith under this Policy.

10.6 Appeals. The Customer may contest any enforcement measure by writing to [email protected], stating the account concerned and the grounds for the appeal. FixAdmin will review the appeal and respond within thirty (30) calendar days. If the appeal is upheld, FixAdmin will restore the affected feature, listing, or account without undue delay.

11. Changes to this Policy

11.1 FixAdmin may update this Policy in accordance with the modification procedure of the Agreement, including advance notice and, where required, in-app re-acceptance for material changes. The version published in-app, with its version number and date, is the version in force.

12.2 This Policy is governed by the laws of the State of Florida, United States, excluding its conflict-of-laws rules. Any dispute arising out of or relating to this Policy is subject to the Dispute Resolution section of the Agreement (Terms of Service), including its informal negotiation requirement, binding individual arbitration, class action waiver, and carve-outs, and venue is as provided in that section.

12.3 This Policy is drafted in English, which is the official and binding version and prevails in case of any conflict, to the maximum extent permitted by applicable law.
